I am lodging a formal, substantiated complaint against the casinos amok, refuel, and mountgold (Infiniza) due to numerous violations of their own Terms and Conditions and Subsidiary Legislation 538.08.
ThePOGG derives its jurisdiction and authority from the Malta Gaming Authority Directive 5 of 2018, the Gaming Player Protection Regulations Subsidiary Legislation 538.08, and the Gaming Act, Chapter 538 of the Laws of Malta. As such, ThePOGG is duly authorized and empowered to scrutinize infractions of the Gaming Player Protection Regulations, Subsidiary Legislation 538.08.
Consequently, a thorough review is both logically and consequentially mandated to ascertain whether the Terms and Conditions cited in this complaint are in violation of the Consumer Affairs Act (Articles 44 to 55) of Malta, as would be indicated by infringements of Article 10 and 11 of Subsidiary Legislation 538.08.
PS: This information may be of interest to ThePOGG. With the approval of the MGA, I filed a complaint with the MCCAA in March 2023. In my complaint, I extensively elucidated that it constitutes a breach of Maltese law (Malta Consumer Protection Act) when casinos register and allow players from these countries (Switzerland, Austria, Germany...) without the requisite authorization or license. The MCCAA upheld my complaint at the end of July. I trust there is no need for me to expound on the potential implications of this decision for the Maltese gambling market.

I assumed that my complaint would be rejected as usual.
You are rejecting my complaint without even submitting it and without knowing what I am complaining about. You are quoting here my complaint that I filed against N1, but the complaint here is about Infiniza's casinos and you have only been Infiniza's ADR for a short time, so we have never talked about it. The MCCAA was also never involved in the complaint against Infiniza, but against N1.
Why are you dismissing my complaint against Infiniza (amokcasino, mountgold, refuel), without even reading it? Why do you just assume that it has to do with the content of my complaint against N1?
It is an absolute RIGHT of a player to be allowed to file a complaint, but here it is rejected without even being read.

I'm allowed to file a complaint against Infiniza here without the MCCAA having to give you permission first, right? I have never filed a complaint with ThePOGG against INfiniza.
I have not even communicated my complaint and the content of the complaint against Infiniza and it is rejected. It is not about the lack of license! They reject my complaint without knowing why it goes at all, making assumptions.

You are entitled to submit complaints without the permission of the MCCAA.
To clarify - you explictly raised your interactions with the MCCAA as part of your grounds for this complaint. Hence providing you with information relevant to your interactions with this body.
We have previously discussed, at great length, every aspect of the complaint you have submitted against Infiniza via the multitude of other complaints you have submitted to this service, including your contention that Play N Go are not allowed to offer services in Switzerland. [For reference of other readers, this complainant submitted two complaints back to back covering the same issues - only one has been published and our response on this file incapsulates a response to all information submitted across the two complaints.]
You already know what our position is with regard to this matter.
I'm sorry that you are dissatisfied with the answers we have given you, but continuing to submit complaints on the same grounds as the cases that we have previously declined will not result in a different answer.
If you want to enforce Swiss licensing standards in respect to your play, you need to contact the Swiss authorities to do so.

We have covered this topic with you repeatedly over the last 15 months. We do not intervene in complaints relating to an MGA operator not having a local license. You have been clearly informed of this over multiple cases.
As you were informed via your other claim that you reverted to us about - https://thepogg.com/complaint/n1-casino-n1-interactive-ltd-violates-the-malta-gaming-authority-s-regulations-regarding-its-t-c/ - we are aware of your contact with the MCCAA. It does not change our position on this matter.
We have discussed your claims at length with the MCCAA, who oversees ADRs, and provided our grounds for declining your claims. Whatever written statement the MCCAA may have provided to you, they have not directed us to re-open your claim, nor have they given any instruction about other similar cases, which you are correct, make up a significant proportion of the claims submitted to this service. Where they were to feel that our practice in this matter had been inappropriate, we would have been informed of that and instructed to adjust our practices accordingly.
