So I excluded myself in 2021 from all casino Fridays casinos. then about two months ago I got an email saying sign up sign up etc. I did so with my new email adress etc / it worked perfectly and there were no issues and they gave me bonus after bonus then after some time I realized that It was my disease acting up again so I told them and asked them for refund or such. they said no.
the exclusion was at casinofriday. the very same casino.
I've used the same banking details the same account with my bank and the same bank id the same name the same everything.

We've reviewed this matter with the operator and sadly we cannot uphold your claim. Far from registering under the same details, you changed effectively every significant piece of registration information. You used an entirely different email address, you altered your first name to include your middle name, you reformatted your address from one one to three, you used a different post code and you used an entirely different phone number.
Where you request a self-exclusion the operator are responsible for preventing you accessing their services under the details that you self-excluded under. Where you change your registration details to bypass the automatic registration blocks the operator would not then be responsible for any losses you subsequently sustain.

I'm afraid that assertion is inaccurate. In the first instance, if your details change it is your responsibility to update the operator, not the operator's responsibility to simply know your details have changed. But more than that, your address did not change. The same address was used, just formatted differently so that an automated check would not identify the matching address, and a different post code was used. This is not a case of you having moved, though you may have, this is a case of incorrect/different details being provided.

I disagree with your position. According to the Gaming Act of 2018 in Malta, specifically under Section 28 which deals with ‘Player Identification and Verification,’ operators are obligated to verify their players’ details accurately.
If the address or postcode was different or formatted in a different way, the gaming company should have caught that mistake and looked into it further. Failing to do this could mean the company isn’t following the law as outlined in Section 28.

Casino Friady isn't licensed by the MGA and would not be subject to MGA licensing standards.
Further to this, the Maltese regulations do not place any onus on the operator to engage KYC checks at point of registration. Even if Casino Friday had been licensed by the MGA, where you alter your information to try to bypass automated checks, the responsibility for any loss after this point resides with you.
But beyond all of this - you did not just change your address. We focused on the address in our response due to the fact that you represented the address issue as down to you moving, when in fact you had used the same address. In fact, you changed every data point in your registration information. Even under the strongest regulatory strictures - including the Swedish regulatory system - no operator would be expected to detect the duplicate account based on the information you provided on your second account.
