Ruling

Found for the Casino - This player is trying to contest that they should have their losses returned because the operator have taken a lenient approach and not enforced a restriction on them.

Player's Complaint

After requesting a withdrawal I was asked to verify all payment methods used in the past on this casino. The casino asked me to prove that the credit card is linked to my bank account. However this is not possible, a few months ago I used this credit card that does not belong to me but to a family member. I've read the T&Cs of the casino and noticed that this is not allowed and payments made with that credit card are invalid.

I've emailed the casino several times and asked to return all payments made with that credit card but I get no answer. The total deposit amount made with this payment method was 3330€ and no withdrawals were made resulting from those deposits.

Hi gozu91 - welcome to ThePOGG.com!

If the payment account holder has not given you permission to use their payment account then they would need to manage this via the payment account provider.

Thanks,

ThePOGG

I did have the permission. Does that change anything? Also this was in march I think it's too late to file a chargeback.

Hi gozu91,

No. If you have the permission of the card holder this simply comes down to the enforcement of a restriction on the part of the operator and the operator are entitled not to place a restriction on a player if they view it to be appropriate in any given situation.

You may find our free Responsible Gambling app BetBlocker useful. It allows users to restrict their internet capable devices from accessing over 12k gambling operator websites for between 24 hours and 5 years.
