Hi,
I have been playing at Harry casino for a little over a month, on the 5/11/13 i was playing on various slot machines @ a bet of 50GBP per spin when I won £13500.
I proceeded to make a withdrawal of £3500 to my Neteller account. The casino asked that I send my documents to them which I did straight away.
My docs were approved and then all my deposits were returned (£300) and winnings confiscated because I broke the casinos 25% max bet rule below;
Your original Neteller deposits have been refunded to your account today. Your winnings had been confiscated as you had not abided by our 25% bonus rule:
- You are not permitted to place bets of 25% or more of your total balance via a single game round, when completing wagering towards a bonus. Players deemed to be adopting such a strategy could potentially be excluded from receiving bonuses in the future. If bonus balance is £20 or less, the max bet is £5.
- Bonuses are to be enjoyed as an extension of a guest's playing experience, and should be enjoyed as such. HarryCasino reserves the right to review any guest account after two months of play to ensure game play is within these generally accepted guidelines. Those found to be abusing bonuses will be welcome to continue playing, but will not be eligible for further bonuses.
As you can see and upon checking the website the term actually says if you break the rule you could be excluded from future bonuses, it does not say confiscation of winnings?
My account was then locked and I had a livechat conversation where again I was told I had breach the 25% rule and I explained again that it does not say anything about confiscation of winnings in this term that is quoted. My case was then forwarded to the "relevant department".
I then received another email saying
We have decided to close your account permanently, because you have violated our terms and conditions regarding bonuses:
2.6. Bonuses/Freespins at HarryCasino can only be received ONCE per person/account, family, household, address, e-mail address, credit card number, IP addresses and environments where computers are shared (university, fraternity, school, public library, workplace, etc.). HarryCasino reserves the right to close your account and confiscate any existing funds if evidence of abuse/fraud is found.
So once I challenged the initial reason for confiscation of my winnings which is not valid at all I was sent the above saying all sorts of things that are irrelevant to me anyway so I would appreciate your help on this if you could mediate as now I am they are not budging on their stance.
I have the livechat transcript and all the emails between myself and casino if you need to see them too?

Hi Gree1 - thanks for getting in contact. I'm afraid to say that I agree with Harry casino in this instance. The simple facts of this case are that you agreed to a contract about your conduct if you accepted a bonus. You admit breaking the rules of that contract. The contract is at that point null and void. Harry casino have simply reset your financial position to the state that existed before your accepted the agreement. They haven't instituted any penalties for your breach of contract. Had they refused to return your deposit, you would have a case. Had you lost your funds betting over the allowed amount, I would have been happy to argue for their return as you would not have been paid winnings. The fact that they have not specifically stipulated that they will void your winnings isn't particularly relevant to my mind - you get the bonus by agreeing to specific terms, if you then choose to break those terms of course your bonus and any associated positives are going to be invalid - you violated the terms agreed to receive the bonus in the first place! If I agree to a 2 year mobile phone contract that comes with a free iPhone, then stop paying after the first month, obviously my service is going to be cut off and the company are going to pursue me for the return of the phone. It's simply common sense that if you break the rules of an agreement, the other party voids whatever benefits you received from the agreement. I'm sure that this isn't the response that you were looking for, but as far as I'm concerned if you break bonus rules confiscation of bonus funds and associated winnings is an absolutely valid response. In future I would strongly encourage you to make sure you are familiar with all bonus terms and conditions before you agree to accept a bonus. Sorry I can't be of further help. ThePOGG
