Player's Complaint

The casino refused to refund, although it is obliged to do so in Germany. As the casino is not entitled to the payments. Here you can get the laws from my lawyer

The organization of games of chance on the Internet without a corresponding license and subject to the reservation of the license is considered to be unauthorized gambling.

Most recently, in its judgment of October 26, 2017, the Federal Administrative Court declared the ban on online gambling to be in conformity with European law and constitutional.

On July 3, 2019, the OVG Schleswig also decided in an incontestable decision that the applicable regulations of the State Treaty on Gambling of the federal states in accordance with Union law and the providers of illegal public games of chance in Schleswig-Holstein must continue to be opposed (file number: 4 MB 14/19).

According to Section 4 (4) of the GlüStV (State Treaty on Gaming), the organization and brokerage of public games of chance on the Internet is prohibited in Germany. The GlüStV also states that participation in payments in connection with online gambling is prohibited. Thus they are not entitled to the payments

In addition, the civil law gaming contract that the player concludes with the online casino is void in accordance with § 134 BGB. Because of this, the player does not owe his promised stakes. Playing games that have already been played can be reclaimed for unjust enrichment in accordance with Section 812 of the German Civil Code.

Unfortunately there is nothing we can do to help you in this instance. As explained in our Complaints FAQs we do not pursue refunds of losses based on lack of license. If your own government cannot prevent unlicensed operators from accepting their citizens, there is no possibility of the operator offering a refund simply on the basis of us asking them to.
