Planet7 - payout check not verifiable

Ruling

Unresolved - The operator has issued a cheque, but the player has deposited this to a brand new bank account who have closed their account as a result. Without written evidence of this the operator will not reissue the cheque.

Player's Complaint

After 2 months, planet 7 issued me three checks for winngs. The first check cleared after 5 weeks. But the next 2 checks were not cleared. My bank, Chase, said they could not verify the funds and not only would not honor them, but also decided to close my account as a result of the deposit. I called planet 7 who's VIP host [EDIT] told me I needed to have the bank provide written documentation proving this was indeed why the funds were not being cleared and the account was being closed. Chase refused to write a letter to planet 7 and told me I needed to bring a representative from the check issuing company to the branch to verify the funds. This is, of course, impossible. I'm am now without a bank account, without my funds and without a course of action on how to resolve this issue. Because chase took the checks in for deposit, I am also without the checks in question although I do have images of the deposit and a deposit receipt. Help!!!!!

What I'd suggest you do is contact your bank and ask them to provide YOU (not the casino) a letter explaining why they've closed your account. If they fail to do this I would suggest contacting your bank's regulator.

Thank you for checking back with me. The only thing the bank would tell me is that they closed the account because the check was bad and they thought I was trying to deposit fraudulent checks. Planet 7 said I needed to prove that the bank said this by having them write a letter to them on Chase letterhead. The bank said I was no longer a customer and refused to write a letter. I then asked planet 7 to verify two things, 1) if the funds were indeed there and 2) if they had been transferred to chase. To date, they have not provided me with that information. So I am still without my $4,620.02 and Only deposit slips and check images to prove that I was indeed cut checks. Incidentally the checks were from Miura Marketing solutions, not planet 7. I also tried calling them but only got a machine every time I called. I can go to Chase's regulator, but I first need to know if the funds were indeed in the account that the check was cut from and if so, does the bank of Montreal still have those funds, or does Chase. In short, it looks unlikely that I'll get any answers or payouts soon. Do you have any additional ideas?

Hi bubbagroove,

It's normal for operators who accept US players to process transactions under different names. It's illegal to process online gambling transactions in the US so this is how they work round it.

You need to write a physical letter to the head offices of Chase requesting a response detailing why your account has been closed. Send this registered post. Do NOT include a phone number or email address but make sure you include a postal address. Make clear that if you do not receive an answer within 6 weeks you will be contacting the Office of the Comptroller of the Currency (https://www.helpwithmybank.gov/complaints/index-file-a-bank-complaint.html).

In all likelihood you will receive a letter back from Chase Bank stating that they have closed your account and giving a vague reason for doing so, but this is likely to be enough to press the operator to take action.

If you could let us know when you've received a response we'll follow this up.

Ok, so I asked Chase why the account was closed. they said because it was my first deposit with them (I opened the account specifically for these checks) and they could not verify the funds, so they terminated the account on suspicion of bad checks. I asked if I could get the company to verify the funds, would they reinstating my account, processing the checks and we'd be done with all this. they said maybe. So, I asked Planet 7 to verify that their bank still had my winnings or if the checks had been processed (still not knowing if planet 7 has the funds, or Chase) I told P7 that Chase said the checks were bad. P7 assured me they were good, but refused to provide any written proof that they were. Finally P7 offered me a deal of a large bonus with low play through and $10000max cash out instead of (what I thought was a rational option) seeing if the checks were processed, if they weren't, canceling the checks and sending me the funds via wire transfer, neteller, or bitcoin or anything other than a check. I didn't agree to the bonus. If I can't get paid for these first winnings, why on earth would I play a cent more with them. Any new advice?

Hi bubbagroove,

I'm just looking back in on your complaint as we've only just managed to re-establish communication with the operator.

Unfortunately, you placed yourself in a problematic situation. If you opened your account with Chase simply to cash this payment out then the bank will view these transactions as suspect and refuse to process them.

Planet7 will not verify anything about this for you for very basic reasons. Online gambling is illegal in the USA. Banks are not allowed to process transactions for online gambling firms. As such online gambling firms accepting players from the USA engage 3rd party companies to manage payments for them, under descriptions other than 'gambling'. While this may be nothing more than paying you the money you won, this is to all intents and purposes money laundering. For that reason the operator will not interact directly with your bank full stop. For them to do so would guarantee that you will not ever get paid.

So we're in a situation where they've sent a valid cheque, your bank has declined to process it because it has come from a source that has likely raised some flags with the bank in the past and closed your account. It costs the operator every time they process a cheque and they do not have full control over the cheques as it is another company handling payments on their behalf.

This all comes back to the same issue I raised at the start - without getting something written from your bank stating that they've closed your account without processing the transaction the operator will not issue further payments.
