Spinia - confiscated winnings

Found for the Casino - This player has exceeded the maximum allowed bet term while playing with a bonus. As such there is nothing we can do to help them.

Player's Complaint

After depositing to spinia I received a bonus (April 15th 17:05:54). I went on playing for a couple of hours and got very lucky. After requesting a cashout (April 16th 8:48:23) I received the message I made a bet of greater then 50+ euro's which caused a cancellation of my cashout and a reset of my balance back to the deposit I made of 100 euro. I do not agree with this. Whilst i understand that laws should be abided and rules are in place for a reason i do consider the reason for confiscating winning are extremely harsh in this case. I must admit i didn't read the small print when accepting the bonus and wasn't aware of the rule i was breaking. So I do confess to pressing the button for a bonus buy which exceeded this 50 euro mark, but the spinia system prevented this bet from being placed. I got an error and got disconnected from the slot machine with exactly the same balance i had before the attempt. In my opinion this means the bet is void and thus not played at all. I do not believe that i "won' the exact same amount as the bet size. Had it gone through and the bet was played i wouldn't be challenging this decision because a rule was broken.

The winning i accumulated i received mainly for playing slots with a bet size of 1 euro. So taking away roughly 1200 euro's of honest winnings on bets that were not played at all is harsh in my opinion. If the bet with a size greater then 50 euro's slipped through the system and got played, regardless of the result, i would agree with the taken sanctions. But taking away this amount of money on not played bets is not something i can understand or agree with. Trying to resolve this issue via the support system spinia has in place proved to be impossible. Why block the payment half a day after the supposed illegal bet has been placed and not make clear directly after placing the bet, which has been void and not played, that playing further is futile because the amount of money in the account would be reset either way.

Long story short. I didn't gain or lose anything from the supposed 50+ euro bet because the site's system did the job of preventing the bet to be played perfectly. Since it did not get played I can't understand why their confiscating should be valid. When a bet is refused it is not placed? And if it is valid why doesn't their system automatically warns / bans people? Now I managed to play myself to a nice amount of winnings just to get the door slammed in my face after requesting a cashout.

Hi lonestar544 - welcome to!

As we are the ADR for the N1 Interactive Ltd license under the Malta Gaming Authority license there is certain information we have to provide you now.

You can find all the relevant information about this service here – and the terms of use for our complaint service here -

To summarise.

– Use of this service does not preclude your seeking redress through court proceedings .

– This service is free to use for both the complainant and operator.

– At any point during the procedure the submitting party retains the right to withdraw their complaint. This does not preclude our right to continue the discussion with the involved operator of general issues related to the complaint (i.e. insufficiently clear terms and conditions).

– You are not obliged to obtain independent or legal advice or representation, though you may choose to do so.

If you have any questions about the above, let me know.

Unfortunately there is nothing we can do to help you in this case. If you have broken the maximum bet term then you have violated the bonus contract you have entered into. The operator are then within their rights to consider the contract void and reset both parties to pre-contract conditions. All we can suggest is that you ensure you read and understand the terms and conditions associated with any bonus you accept in the future.

Sorry we cannot be of more help.
