Mansion - Removing win

Ruling

Found for the Casino - The player claims that the maximum bet term that is being enforced to confiscate their winnings was not in place at the time they played in March. They could provide no evidence to support this claims.

We checked with the term monitoring service we use, the Google Cache and the Web Archive with inconclusive results.

Reviewing another complaint against Mansion casino from the same period this year, we could confirm that the term was in place in the general terms and conditions in March. Given that this issue did not involve promotion specific terms and conditions, the general terms and conditions would have been the default for the bonus and as such the player should have been aware of this term.

Player's Complaint

Hello. I am disappointed by the casino Mansion. I won the money with no deposit bonus of 10 free in March 2015 . The moment I read the rules and there were no limits on the maximum bet on free bonuses. 5 days ago I decided to cash out the winnings and they removed all winnings citing new rules 10 % of the bonus amount. As I understand it, it is a violation of the rules. In retrospect, no casinos are not allowed to use prohibitions. In March there were no limits on the amount bet on the no deposit bonus. Help me ....

Hi Grekho - welcome to ThePOGG.com!

I need more information from you before I can do anything to assist you. Firstly I need the url of the bonus you claimed. I also need your username and email address at Mansion casino.

Thanks,

Hi Grekho,

I'm afraid to say that there's not going to be much I can do for you.

The page that contains this term is hxxp://www.mansioncasino.com/terms/general.html

I've checked with the terms and conditions monitoring service we use. We were not monitoring the specific page that term was present on and nor was anyone else.

I've checked the Google cache - the last copy I can see is from the start of July and has the maximum bet term.

I've checked Wayback Machine and they have only scanned this page once and that was in September last year. At that point the page was completely different.

Without something that demonstrates that the term wasn't there at the time you played I don't have anything to confront the casino with. Unless you've got a screen shot of the terms from the time you played I'm afraid I'm out of ideas.

Hi Grekho,

I've received your email. Unfortunately there are 2 issues with the URL you sent through.

1) This url is for the affiliate site your signed up through. Terms and conditions shown on an affiliate site cannot be considered binding. If the affiliate fails to update the terms at the relevant time that cannot be considered the casino's fault.

2) Nothing on the page displayed states that there was no maximum bet rule. The bonus provided there would still be subject to casino general terms and condition. There are many casino rules that are absent from the very brief description that site provides, that doesn't mean they don't apply.

To have workable proof the terms would need to be shown on a "mansioncasino.com" url. Without that there's not a case for me to fight here.

Thanks,

Hi Grekho,

I don't particularly appreciate the accusations you've made. If you feel the service that we're providing is trying to protect the casino, feel free to take your issue to someone else to get help. Perhaps to the affiliate site where you found the bonus.

You should be aware that we do NOT work with Mansion casino and actively advise players not to play with them, so the claim is utterly without bases.

I have nothing whatsoever to suggest that the term in question was not in place at the time you played other than your claim. What exactly do you expect me to support you with? As to the casino manager, surprisingly enough, I don't have the contact details for the casino manager at what is a large casino group who this site specifically lists as 'Not Recommended'. Even if I did, if the casino has decided to enforce this term - presumably you've already made clear to them that you do not feel it was in place at the time you played? - why would they now turn round and admit it wasn't there?

If you can provide no evidence to support your claim, what possible reason would there be for the casino to overturn their decision?

Hi Grekho,

The difference between your situation and the complaint you referenced (http://thepogg.com/complaint/mansion-unjustified-cancellation-of-payment/) is that the bonus in the other complaint had terms on the casino landing page that could be reviewed. So when I went to the affiliate page and clicked the link for the bonus it took me to a page on the Mansion casino site that showed the terms and conditions for the bonus. The maximum bet term was not there. It was in the general terms and conditions, but as the terms for the bonus did not show it this could be considered misleading.

In your case, when I click the link on the affiliate site, it doesn't take me to a bonus specific page, but rather a generic landing page with no terms and conditions. As such the general terms and conditions would be considered valid.

As that case was submitted in March - the same time you played - and I can confirm that the general terms and conditions did contain the maximum bet term, this supports the term being in place at the time you played.
