BETAT - Account closure and confiscated funds

Ruling

Found for the Casino - BETAT casino have provide enough evidence to demonstrate that this individual is highly likely engaged in the operation of multiple accounts under names other than their own. This is a clear violation of terms and conditions and ThePOGG.com will take no further part in the representation of this individual.

Read our BETAT Casino Review.

Player's Complaint

Signed up at Betat Casino and provided my verification documents by email on 4/10/16. The terms stated that it could take up to 5 days for the verification to be completed. I have since been on Live Chat and email asking for an update, with very generic responses such as:

-The delay is due to the extraordinary high volume of UK players verifying accounts at the moment.

-Unfortunately the verification team still do not have an exact time frame for when your account will be verified.

-We are doing our utmost to speed them up as much as possible

I then received an email on 29/10/2016 with the following:

Please be informed that your account has been flagged for fraudulent behaviour. Due to this, we are required to terminate any direct line of communication with you immediately.

Consequently we have now permanently closed your account, forfeited all funds and removed your email address from our mailing list.

No further correspondence on this matter will be entered into directly. Should you wish to discuss the matter further, you may raise this case with the Malta Gaming Authority who will act as the legal mediator between both parties.

Regards,

BETAT Risk Department

I have had no response from The MGA so coming to you as one of the mediators as I have heard you may have had a few similar complaints regarding this casino.

Please note that I do not remember the exact amount owed to me, but I do know it was around the mark I have indicated in the field.

Thank you

Hi Alkey121 - welcome to ThePOGG.com!

As a UK citizen and as we are the officially appointed Alternative Dispute Resolution service for BETAT Casino there is certain information we have to provide you now.

You can find all the relevant information about this service here – http://thepogg.com/terms-of-use/

To summarise.

– Use of this service does not preclude your seeking redress through court proceedings .

– This service is free to use for both the complainant and operator.

– At any point during the procedure the submitting party retains the right to withdraw their complaint. This does not preclude our right to continue the discussion with the involved operator of general issues related to the complaint (i.e. insufficiently clear terms and conditions).

– You are not obliged to obtain independent or legal advice or representation, though you may choose to do so.

The above is somewhat clunky but a necessary part of the process for any complaint that comes in under ADR procedures.

If you have any questions about the above, let me know.

As far as receiving no response from the MGA - as a UK citizen the MGA defer complaints to the UKGC. In this instance (not for all UK licensed operators), ThePOGG.com is the body responsible for managing complaints against BETAT.

You've also mentioned that you have "heard [we] may have had a few similar complaints" - I would appreciate it if you could tell me where you got this information?

Thanks,

ThePOGG

Hello, sorry for the delay. It was done after looking on google for betat and closed accounts etc. Unfortunately, I can't remember the exact forum I found the information on. Sorry I couldn't be more help. Look forward to hearing from you

Hi Alkey121,

I do find that interesting and rather odd. Your specific statement states "as I have heard you may have had a few similar complaints". We have only had 2 completed complaints overall against BETAT neither of them related to this issue. For their sister property Slotty Vegas we've only had one complaint that's been completed and again it's entirely unrelated to this issue.

We do however have a large number of complaints that are currently open (i.e. have not been published, are not accessible to anyone other than the complainants and admin and do not show up in Google) from the same time period that you yourself quote. Given that these are all related to accusations of fraud by the operator, unexplained connections between the complainants somewhat supports the operator's case. If you could have a think about it and see if you could remember where you heard we were dealing with a number of these cases it would help establish that this connection is mundane in nature rather than questionable.

Thanks,

ThePOGG

Hello, I will have another look for the forums. It looks like I have worded my complaint badly. It wasn't meant to look like I knew about any of the open cases you have against betat. The forums more mentioned that you were the ADR for this casino and that you had a dispute mediation page. I'm still not sure how it could be questionable as I sent in my identification verification etc.

Hi Alkey121,

If you would it would help. Unfortunately your initial statement isn't vague and specifically indicates knowledge of other complaints against this operator that have not yet been made public, meaning that you must be in communication with at least one of the other complainants, one of the other complainants is posting about their experiences publicly or that you've submitted a complaint under another name. Obviously 2 of those 3 would constitute fraud and the middle option possibly indicates a syndicate which is also prohibited in terms and conditions. It would be very useful to your case to clear this specific aspect up.

Thanks,

ThePOGG
