Casino 1 Club - Rejected withdrawl

Ruling

Found for the Player - The player breached a term restricting the amount of any deposit that can be bet on a single round. We have reason to believe that this term breached European consumer law, but from previous experience we know that this group will enforce it anyway.

Player's Complaint

Hi.

I have been playing on casino1 site.

Username [EDIT]

I requested a withdrawal of €5800. After 3 days waiting to be contacted about my security details I recited an email saying my request had been rejected and my winnings cleared off my account. Due to irregular betting. I have contacted them on numerous times and all they say is I broke there terms and conditions  . Please can you help as I feel like they just don't want to pay out. I may have gambled higher bets later on but I would have had at least €4000 in credit before this. And there t&c are very vague.

Thank you

Hi bikermice69 - welcome to ThePOGG.com!

Before going any further I need you to confirm how much you deposited, the value of any bonuses you received, what games you played and the top bet amounts placed while playing?

Thanks,

ThePOGG

Hi. I deposited £50 and received a 400% deposit bonus. I was playing mainly on trump it which they have taken off there mobile site. The most I wagered was €25. But this was only after I had accrued 4000 in my bank before that I had only wagered €15 .

Thank you

Hi bikermice69,

Unfortunately your bet of €25 breaks the following term:

"16.2 We reserve the right to withhold any wthdrawals and/or confiscate all winnings and bonuses for irregular play.

. "Irregular play" includes, inter alia:

Placing total bets equal to or greater than 30% of the value of the deposit currently in play."

This term is not bonus specific, but applies to all deposits. While we don't like the term and have reason to believe it contravenes EU consumer law, we have dealt with this group with this type of issue before and they will hold to this term. As such I'm sorry to say there's nothing we can do to help you.

Hi bikermice69,

Unfortunately I don't have any good news for you in this respect. As far as I'm aware this group do not have any holdings within the EU. The MGA are pursuing a historic case for us, but this was from the period when this group were regulated in Malta. That's not been the case for some time now. Even the MGA are struggling to find options now that this group have retreated out of European jurisdiction.

The only suggestion I can make would be to try and challenge the decision in a court in Curacao, but I have no experience of doing this and am not aware of any player who has successfully done this.

Sorry we can't be of more help on this front.

On a side note, as a UK player you should only play with operators that hold a UKGC license. Any operator that accepts you without a UKGC license is breaking UK law. We already reported this group to the UKGC due to these violations previously.

Thank you again. I think my €5800 will never be seen. I have since been on to casino1 and have been told by them they are legally allowed to allow uk players on there site. But thank you again for your help.

Hi bikermice69,

Yes, that's become a standard approach for this group of operators. I can state as absolute fact that this group are not UKGC licensed, do not pay tax in the UK for their UK players activity and are therefore breaking UK law when they allow UK citizens to play.
