Las Vegas USA – not paying, continues to give me runaround 1.5 years later

Ruling

Found for the Player - This player won $18k, was waiting on withdrawals being paid by Las Vegas USA. 6 months pass and the operator's only managed to pay $12k. They then close the player's account based on dormancy rules, seizing the remaining $6k.

Firstly, a player cannot be considered dormant under these circumstances. The lack of activity on the account is directly attributable to the operators slow payment of due winnings. The player has no incentive to play, the objective of play being to win more money, when the operator is already struggling to pay the money they've won.

Secondly, this type of policy actively incentivizes the operator to stall payments of any significant win in the hopes that the dormancy period will pass and they can void a significant proportion of the balance.

The operator has refused to move on this issue and as such will be shifted to Blacklist status. Players should actively avoid playing with this group.

Player's Complaint

won around 18k on november 15 of 2016...still have over 6600 in pending payouts. have contacted finance chat about 40 times since and they have given me the same nonsense about "contacting their payment provider at the earliest" payments have always been slow but now have completely stopped for over 4 months, my last payout was 12/27/17. they have also given me excuses such as i am not an active player...despite not having paid me my balance from 2016....please help, at this point i do not know what else to do.

Hi dinkanddunk777,

I've had a rather extended conversation about this issue with Las Vegas USA. The short of this situation is that you're not going to be paid.

Term that the operator has cited as justification for seizing your funds is as follows:

"1-The casino reserves the right to close any account in which there is no activity within 180 days. Not placing a bet, not making a deposit or withdrawal, or not accessing the account, within this period, are considered examples, but not exclusively, of account inactivity and consequently, any balance is forfeited."

So what's going on here is that you won $18k, it took the operator over 6 months to pay you $12k and because you haven't played in that time they now feel they have the right to void the remaining $6k.

Obviously this is patently entirely. In the first instance what incentive do you have to play to try and win more when it's taken 6 months and they haven't managed to pay what you'd already won? Secondly, this type of 'play or we won't pay you what you've already won' is financial hostage taking and runs contrary to any commitment the operator has to Responsible Gambling (forcing a player to engage in play beyond what they'd choose to). Finally this policy actively creates incentive for the operator to slow pay players who have had big wins. By ensuring that they take over 180 days to pay they're going to ensure that they can void balances for a lot of players.

This is totally unacceptable to us and we've made that entirely clear to the operator with no success.

As a result of this issue Las Vegas USA and the other operators associated with this group will be moved to Blacklist status when this complaint is closed.

Sorry we could not be of more help!
