LeoVegas – Winnings Confiscation

Ruling

Found for the Casino - The term that LeoVegas have enforced restricting sports betting is clearly present in the General Bonus Terms and Conditions. As such there's no ground for us to seek payment.

Player's Complaint

My winnings from Leovegas' welcome offer were confiscated due to 2 terms of service violations described in live chat:

1. Casino bonus wagering may not be completed whilst a sports bet is pending

2. Irregular play patterns

There is nowhere in either general or welcome offer terms that states anything about pending sports bets relating to bonus wagering. Also I do not agree with their undefined "irregular play patters" accusation.

I have a live chat transcript detailing their reasons for confiscation of my winnings. I disputed their actions and have sent a formal complaint to their support email.

Was advised to seek your assistance

Thanks for the reply. I have just forwarded 2 emails to your complaints address. The first is a separate copy of my initial live chat session where i was informed of the confiscation. The second is my email communication with Leovegas support.

Please do not hesitate to contact me if there are any further details necessary

Hi qwerty1234,

I've reviewed your email. It would appear that you deposited £300, received a £300 casino bonus then went on to place a £300 wager on a tennis match (using your deposited funds). You then played with only the available bonus money on slots games.

Your argument seems to hinge on the fact that the relevant term prohibiting sports betting while playing with a casino bonus appears on the General Bonus Terms and Conditions page rather than on the Welcome Bonus Terms and Conditions page. When accepting any bonus you are bound by all terms and conditions applicable to the bonus, this includes both those terms and conditions that are specific to the bonus you accepted and the general terms that are applicable to all bonuses. Purely on this basis, the term in question is present and clearly interpreted. As such the operator would not be outwith their rights to void your winnings based on the sports bet violation.

Another aspect to your complaint to Leo Vegas appears to be that you feel that the terms are laid out in an inappropriate fashion. Unfortunately we would not be the correct body to make a determination on this aspect of your case. If this is the argument you wish to put forward you need to contact the UK Advertising Standards Authority who will be able to make a ruling on whether or not the terms as laid out are compliant with UK law.

Thanks,

ThePOGG
