Mega Casino – Confiscated funds

Ruling

Found for the Casino - MegaCasino have pointed out that this player exceeded the maximum allowed bet, something that the players account agrees with.

Read our MegaCasino Review.

Player's Complaint

I made a £20 deposit with this company and played a game, winning over £4,500. Upon requesting a withdrawal, they replied saying that the particular game on which I played (Super Monopoly Money) was not eligible for bonuses and they have confiscated my winnings. This seems arbitrary and wasn't at all clear in the bonus terms and conditions which I read thoroughly before depositing.

Hi notnef89 - welcome to ThePOGG.com!

Before we can do anything to help you I need you to provide us with the username and email address you use at MegaCasino.

It would also be useful to know which term specifically the operator quoted that you'd broken.

Thanks,

ThePOGG

Hi notnef89,

Thanks for your email. I've reviewed the information contained within. While the email you received does stipulate that you played a restricted game, this was a secondary issue to exceeding the maximum allowed bet.

Having reviewed the terms and conditions at MegaCasino the two relevant terms are as follows:

6. While making bets to wager any deposit bonus/offer (free or deposit) the maximum bet permitted is 5 (eg, 5 EUR, 5 GBP) or 10% of the bonus amount (the lower amount applies) Failure to comply with this rule means you are in breach of the deposit bonus/offer terms and We reserve the right to void and remove any winnings. A bet includes any special bet feature, any gamble function or any other type of wagering activity (regardless of its name).

and

Excluded Games: Excluded games are all table games*, all live casino games and all video poker games*. Also some slot games are excluded games and how to tell is when you enter a slot game, if you see that the available balance to play includes only your real money balance this means the slot is an excluded game. It is very important you read clause 40 which details the consequences of playing excluded games while having an active bonus.

*if the bonus wagering group is Mixed or Special Mixed Wagering (see clause 27) you are allowed to play table games and video poker games.

If this issue is solely related to playing a restricted game, as the terms and conditions clearly stipulate that your bonus becomes inactive when you access a restricted game you are absolutely right that this wouldn't be a good justification for removal of winnings.

If however, as the email suggests, you've also exceeded the maximum allowed bet, this is a clear term and a clear violation. If you have bet more than £/€5 or 10% of the bonus amount received (whichever amount is lower) then there's nothing we can do to help you.

If you can confirm whether you remained within the betting limits I'll review the case from there.

Thanks,

ThePOGG

Hi notnef89,

Can you confirm whether you remained within the betting limits?

Hi notnef89,

Thanks for confirming that you're maximum wager was £4. With a deposit of £50 this would below both the £5 and 10% of the bonus cap.

Unfortunately MegaCasino have responded to our requests to discuss this issue and have informed us that they will not assist players with complaints on this site.

MegaCasino's platform provider - SkillOnNet - have been Blacklisted at ThePOGG as we found them running a non-random game previously - http://thepogg.com/skillonnet-software-non-randomnot-fair/. As such they've decided that they will not assist players with complaints via our service until such time as we remove them from our Blacklist.

They claim this decision has been taken due to concerns of bias against them. However, this explanation doesn't bear scrutiny as various SkillOnNet operators continued to cooperate in the resolution of complaints for an extended time period after the software platform was Blacklisted and the rulings of the complaints managed during this time period strongly favoured the operator.

Regardless, the reality is that this operator will not cooperate with us to assist you with your issue.

If, as you say, your bet never exceeded £4 it would be my opinion at the present time that you should be paid. If that is the case you have not exceeded the maximum bet term and as far as I can see from the MegaCasino terms and conditions Super Monopoly Money is not listed as restricted anywhere. As such this complaint will be marked 'Found for the Player'.

MegaCasino have requested that we direct you to a forum that they will work with. As such I would recommend contacting Max at CasinoMeister, you may have more success there.

Sorry we couldn't be of more help,

Hi notnef89,

I've had a response from MegaCasino regarding this issue and I have to a mistake I've made above.

I assumed that you had a bonus of £100, meaning that £5 would have been the lower of the £5/10% of the bonus limit. MegaCasino have pointed out that the bonus you've received was in fact £20, meaning that your maximum allowed bet would have been £2. They state that you placed a total of 175 bets that were over this limit when you played.

If the above is true - and it would appear to be as you've already stated that your largest bet was £4 - there's nothing we can do to help you. MegaCasino were right to confiscate your winnings as you have breached bonus rules.

If the above is not true, I need you to go into your game history and take screen shots of your play from the 14/08/2016. You can forward these to [email protected]

Thanks,

ThePOGG
